The Stephen Lawrence Inquiry: Coronial Aspects

The Report of the Stephen Lawrence Inquiry was published on the Internet on 24 February 1999. In the Report, the inquest is described and discussed in Chapter 42. A large number of Recommendations are made in Chapter 47. These include two of relevance to coroners’ inquests, which are set out below:

"42 That there should be advance disclosure of evidence and documents as of right to parties who have leave from a Coroner to appear at an Inquest.

43 That consideration be given to the provision of Legal Aid to victims or the families of victims to cover representation at an Inquest in appropriate cases."

These recommendations were the subject of an article in the New Law Journal (Matthews, (1999) 149 NLJ 418).  They have since been accepted in part by the Home Secretary in his formal response, ie for No. 42 "in relation to deaths in custody", and for No. 43 "in relation to exceptional cases".  But the Home Secretary does not intend legislation to deal with No. 42: instead it will be dealt with only by non-statutory schemes: see Deaths in Custody.
