Re Maddison (deceased), The Times, 28 November 2002, DC
On 18 November 2002 the Divisional Court allowed an application under the Coroners Act 1988, s 13, by the Coroner for Wiltshire and Swindon for an order quashing the misadventure verdict on the inquest into the death of an aircraftman who died at Porton Down military research establishment in 1953, during an experiment involving nerve gas.
In ordering a new inquest, the court relied on the facts that the death of a soldier at the hands of the State was a matter of real public concern and interest, that the previous coroner had not been provided with a full account of the circumstances of another relevant experiment, and that the previous inquest had been held in camera and the family had been kept in ignorance of the true situation.
