We are delighted to announce that the IBA Toolkit on Insolvency and Arbitration, co-chaired by Dr Manuel Penades Fons, has been nominated for ‘best innovation by an individual or organisation’ at the Global Arbitration Review (GAR) Awards 2021.

The toolkit provides guidance to parties, counsel and arbitrators in situations where a party to arbitration proceedings is also subject to insolvency proceedings in one or more jurisdictions.

Dr Penades Fons said, “I am delighted the IBA Toolkit on Insolvency and Arbitration (which I co-chaired) has been nominated as one of the top Arbitration innovations of the year by Global Arbitration Review.

He continued, “The Toolkit is the first ever detailed comparative study on insolvency and arbitration, covering 4 continents, circa 20 jurisdictions and over 500 pages. Most importantly, it is the first at comprehensively identifying the issues triggered by the insolvency of a party to arbitration and signalling “step-by-step" a way to proceed for arbitrators.”

The Toolkit was a very needed innovation in the current, and forthcoming, economic climate
