International Arbitration

This Executive Course provides a comprehensive foundation in international commercial arbitration, taught by renowned experts from King's College London and prestigious global practitioners.

Combining rigorous academic instruction with practical insights, the course runs online in intensive 3-hour sessions on Fridays over a 6-week period, allowing participants to balance professional commitments with advanced legal education.

Programme Schedule 

Each week explores a key theme in international commercial arbitration through academic seminars and practitioner-led discussions.

Please note: The schedule below is an example and is subject to change.

Sessions take place online each Friday from 11:30-15:00 (BST). The weekly structure is as follows:

  • 11.30-12.30: Seminar
  • 12.30-12.45: Break and introductory discussion with guest speaker
  • 12.45-13.45: Seminar delivered by a guest speaker.
  • 13.45-14.00: Break and follow-up networking discussion with guest speaker
  • 14.00-15.00: Seminar

Week One: Key Notions of International Arbitration and the Arbitration Agreement

  • Introduction to international commercial arbitration
  • Regulatory framework: New York Convention, UNCITRAL Model Law, national laws, arbitration rules, and soft law
  • The arbitration agreement: concept, types, key elements of an arbitration agreement. Tips on negotiation.

 

 Week Two: Advanced Issues on Arbitral Jurisdiction

  • The jurisdictional effects of arbitration agreements: Principles of Kompetenz-Kompetenz and separability
  • Objective and subjective scope of arbitration agreements; and pathological clauses
  • Enforcement of arbitration agreements via courts and tribunals; Art. II NYC, sec. 9 EAA, art. 8 UML, enforcement through judicial appointment of arbitrators and interim measures; sec. 32 EAA; antisuit injunctions

 

 Week Three: Arbitrators – Appointment, Challenge, Duties and Powers

  • Selection and appointment of arbitrators: Approaches and strategies
  • Duties of arbitrators (incl. independence and impartiality, and IBA guidelines on Conflicts of Interests) and challenge
  • Powers of arbitrators, including interim measures

 

 Week Four: Arbitral Procedure and Applicable Law

  • Arbitration procedure and confidentiality
  • Preparation and submission of evidence
  • Laws applicable to procedure, agreement, and merits

Week Five: Awards and Setting Aside of Awards

  • Types and legal effects of arbitral awards
  • Grounds for setting aside: jurisdiction, due process, excess of mandate, arbitrability, public policy
  • Appeal mechanisms and legal frameworks

Week Six: Recognition and Enforcement of Awards

  • Recognition and enforcement under the New York Convention
  • Strategies for award satisfaction: asset tracing, assignment/sale of awards
  • Enforcement of set-aside awards
